Gazette Farm Road Article - plaintiffs win first battleOne of the families who on property along Farm Road has filed a lawsuit in an attempt to have their property rights re-recognized by the local Planning Agency.
On March 13, 2008, a Montgomery County Circuit Court judge granted a series of default judgments against a number of defendants thereby re-establishing the easements that traversed a portion of the Farm Road. Although the entirety of Farm Road was not before the Court at this particular hearing, all of the Farm Road easements that were before the Court on that particular day has now been recognized.
Unfortunately, the last section of Farm Road, which connects to the public road remains blocked and will not be adjudicated until the Fall of 2008. In the interim, Farm Road property owners continue to be denied access to the properties. The Gazette article is linked below.
